A. Introduction
- These Terms of Use must be read before using the website. The Terms of Use form the legal basis and regulate the relationship between you and the PassportCard Israel Group in connection with the website (“Terms of Use”). By using the website, including registration, you confirm that you have read and understood the Terms of Use and agree to all the provisions and conditions contained within them. If you do not agree with any term of the Terms of Use, you must immediately cease using the website.
- The PassportCard Israel Group operates in the following areas:
2.1. Travel insurance, administration of medical expenses, and management of payments to medical providers for those traveling abroad, as well as related or ancillary services (“Travel Services”). Travel Services are provided by PassportCard Israel General Insurance Agency (2014) Ltd. (hereinafter: “PassportCard Travel”).
2.2. Medical insurance, administration of medical expenses, and management of payments to medical providers within medical plans, or providing related or ancillary services in connection with relocation or other long-term stays abroad (“Relocation Services”). Relocation Services are provided by DavidShield Life Insurance Agency (2000) Ltd. (hereinafter: “PassportCard Relocation”).
2.3. Financial services, including the issuance of the PASSPORTCARD payment card (“PASSPORTCARD” or “the Card”) for making payments to clients in connection with Travel Services and/or Relocation Services, foreign currency exchange services, and charging foreign purchases to the PASSPORTCARD, as well as services for indirect tax refunds (VAT, etc.) for purchases in countries where tourism purchases are exempt from such tax (hereinafter: “Financial Services”). Financial services are provided by PassportCard Financial Services Ltd. (hereinafter: “PassportCard Financials”).
PassportCard Travel, PassportCard Relocation, and PassportCard Financial Services (collectively referred to as the “PassportCard Israel Group”) are part of a group controlled by DavidShield-PassportCard Ltd., Registration No. 515857639 (hereinafter: the “Holding Company”). The aforementioned companies, as well as any company or entity operating or that will operate in the future under the control of the Holding Company, directly or indirectly, are collectively referred to as the “PassportCard Group.”
B. General
- The use of this website by PassportCard Israel General Insurance Agency (2014) Ltd., DavidShield Global Life Insurance Agency (2000) Ltd., PassportCard Financial Services, or the parent company and/or affiliated or related companies (hereinafter collectively referred to as “the Company”), including the use of information and/or links to other information sources on the website and/or through it, as well as the submission of any information, receiving offers, and/or purchasing insurance policies and/or products and/or services through this website (hereinafter referred to as “Website Use”), is subject to the terms outlined below. By using the website, you agree to accept them and undertake to comply with them. Therefore, if you do not accept any of these terms, you are requested not to use this website. Use of the website will be considered as your agreement to all the terms, conditions, and notices.
- Please heed to the Terms of Use; the use of the website constitutes your agreement to the terms specified below.
- The group reserves the right to change and update the Terms of Use.
- All actions and operations carried out through the website provided by the company are recorded and documented.
- The group reserves the right to suspend, cancel, or refuse to provide the services it offers, in whole or in part, including restricting access to the personal area, in any case of providing false, outdated, incomplete, or incorrect information at the time of purchasing products and/or services or thereafter, or if the group has reasonable grounds to believe this has occurred.
- Insurance products are not available to everyone and in every country and are subject to regulatory, insurance, and other requirements.
- It is your responsibility, as a service recipient who is a resident or citizen of a foreign country or currently located in a foreign country, to examine and verify whether the service and the terms of use of the service comply with the laws of the foreign country. The group is not able to tailor the service and terms of use according to the laws of each country in the world. Therefore, it is clarified that you will bear sole responsibility for any violation of the law of a foreign country if it occurs as a result of using the service.
- It is clarified that digital services are not offered to you if you are in a place where their use is not permitted according to local law.
Specific Instructions Regarding the Travel Insurance Policy
- Eligibility to purchase travel insurance is primarily for citizens of the State of Israel over the age of 18, and for purchase while the applicant for insurance is in Israel, prior to departure abroad. Upon receiving the purchase confirmation that we will send you, you are entitled to the benefits and coverage specified in the insurance policy you purchased, starting from the date it takes effect until the last day stated in the insurance certificate. “Abroad” for this purpose means any country outside of Israel.
- Travel insurance products which are available for purchase through this website, through PassportCard Israel’s telephone sales center or through an insurance agent and/or any other channel offered by PassportCard Israel, are not available to everyone and in every country, and are subject to various conditions, limitations, and requirements.
- It is clarified that the purchase and issuance of a PassportCard Israel travel policy while you are abroad is invalid and constitutes a violation of the Terms of Use, including the cancellation of the policy from its commencement, and any consequences that result from it.
- It will be clarified that the provisions in sections 9-11 do not apply to the purchase of a PassportCard Relocation policy.
Your obligations as a condition for using the site:
13. Prohibition on illegal or prohibited use – As a condition for using the site, you agree not to use it and/or the content appearing on it for illegal purposes, or for any purpose prohibited by these terms and conditions and notifications, and/or according to any law.
- Impersonation of any person or legal entity using the site.
- Claiming, sending, or transmitting any material containing any type of computer virus or any other computer code designed to destroy, disrupt, or limit the use (including any use other than fair and reasonable use on the site) of any of the computers, servers, hardware, and software used by the group to provide services.
- Spamming or flooding any other mail on the servers through which the services are operated.
- Modifying, processing, adaptating, sublicensing, translating, selling, reverse engineering, disassembling, or reassembling any part of the code comprising the site and similar actions concerning the hardware and software used to provide the services.
- Infringement in any way of copyrights, trademarks, or any other intellectual property rights that exist on the site.
- Placing the services, or any part of them or any part of the site, inside a frame of another site, or as part of another site (mirror), or as part of another service without obtaining explicit written consent from PassportCard International Travel or PassportCard Relocation, and any other company in the group.
- Using any robot, “worm” (spider), search engine or other automated tool, or any other manual tool designed to index, retrieve, and locate information on the services and/or site, or such a tool designed to expose the database structure and code of the services and/or site.
- Interrupting or disrupting the services and/or site in any other way, including by disrupting the server operations, or the computer network connected to the services and/or the site or the computer network connected to them.
- Uploading and/or sending through the site any material and/or message that is illegal, immoral, offensive in any way, or irrelevant.
- If you are required to submit content to the company, whether through the site, do so with extra caution. You must avoid unwanted disclosure and/or consent of your data and/or personal data of third parties. Without derogating from the above, the group or any of its companies may remove or edit messages uploaded by you to the services at its sole discretion.
- If you decide to register on the site, the username and password you choose will be for your personal use only, and you are not allowed to transfer them to any other party without the explicit consent of the company. Additionally, you are required to take all measures to maintain the confidentiality of the username and password, including not saving them on your personal computer, and you agree to bear all damages caused by their use by an unauthorized party.
- It is clarified that the company cannot monitor all information and/or messages uploaded to the site by other users, and it will not be responsible for any damage and/or loss that may result from or in connection with this.
- You agree and undertake to indemnify and hold harmless the company, its directors, officers, shareholders, employees, agents, and anyone acting on its behalf against any claim, demand, and expense, including legal fees, arising from any use you make of the site in violation of the terms of use.

You must refrain from making changes, copying, distributing, transmitting, displaying, performing, duplicating, publishing, licensing, creating derivative works, or selling any part of the information, software, products, or services originating from the company’s website.

- Accessing the personal area via the website will require two-step verification, and entering additional details such as ID number, email address, policy number (or any other identifying detail, at the group’s discretion). These identification methods will allow for more rigorous identification and safer use of the company’s services.

The use of this information and any other information about you will be subject to the Privacy Policy of the group companies. The Privacy Policy of the group companies is available for your review at any time by clicking on the “Privacy Policy” link on the group’s website.
- You agree to provide truthful, accurate, complete, and current information about yourself when purchasing a product and/or service and in any service request related to the services and products provided by the group companies. You also agree to update the information, if necessary, to maintain its accuracy and completeness.

- The site may contain links (Hyperlinks) to third-party websites/applications. These links are provided for your convenience only. The group companies have no control over these third-party websites/applications and are not responsible for the content that appears on them, or the content that does not appear. The inclusion of these links does not imply approval by the group companies of the content on those sites, nor does it indicate any relationship between the group companies and the operators of those websites. Additionally, the group is not responsible for the software or any other means available on those websites or for any direct or indirect damage that may occur to your equipment (software or hardware) when browsing these websites. The same applies to the use of Skype software for contact purposes.
- The website may allow users to post messages. These messages are solely the responsibility of the senders, and the group will not bear any responsibility for them.
- Advertisements that may appear on the site from time to time, if any, do not constitute an offer and/or advice and may not take your specific data into account. They should not be interpreted as recommendations and/or opinions and/or substitutes for your independent judgment.
- If the services and/or products offered are provided to you by any third party, that third party will be solely responsible for all the products and/or services provided by them.
- If you find any information on the site or in the content of any other service linked from it, which seems incorrect, illegal, immoral, or does not meet user expectations, you are requested to notify one of the group companies via customer service by phone or through the chat.
Liability and Risks
- It is clarified that the group companies’ systems, being based on software, hardware, and communication networks, are exposed to inherent risks typical of such systems, including harmful programming (viruses, Trojan horses, etc.), eavesdropping on communication lines, hacking by malicious parties, impersonation of the group’s websites or systems, and other online frauds. The group invests considerable efforts to protect against these risks, but despite these efforts, there is no absolute way to block them, and damages and/or losses may occur as a result of any of these risks, including the disclosure and/or disruption of information transmitted and/or displayed in the systems, including disruptions in instructions/requests, unauthorized actions in accounts, disruptions in system operations and/or response times, including non-performance, incorrect performance, and/or delayed execution of instructions/requests, lack of system availability or any of its services, etc.
- It is clarified that the services will be provided by the group companies according to the client’s instructions and/or those of a party authorized by the client, and with the client’s approval, subject to the terms of use. To reduce the exposure to misuse and/or impersonation, you must immediately and without delay notify of any suspicion of impersonation and/or misuse and/or access to your personal area in your name and/or the loss or theft of your device or any case where there is concern about the misuse of the device for accessing the website.
- Without detracting from anything mentioned in these terms of use, the group companies will be exempt from liability for any damage, loss, or expense that may be caused to you, directly or indirectly, due to any of the following events/factors, provided these factors are not under the group’s control and the group made reasonable efforts to prevent them:
40.1 Disruptions, discrepancies, errors, or inaccuracies, or non-performance or delayed performance of an instruction due to communication line failures and/or malfunctioning electronic or mechanical systems, either on your end, the group’s end, or a third party through which instructions and information are passed, even though we make every effort to ensure the quality, reliability, completeness, and accuracy of the information, calculations, and content included in them.
40.2 Malfunction of any software and/or hardware on your end, including any software and/or hardware provided to you by a third party.
40.3 Disclosure of your information to a third party as a result of using the site (including third-party products and/or services offered during the use of the site) or as a result of providing inaccurate information and/or transferring your device to another person, including for repair purposes, where the other party may view information in your personal area or perform various actions using the device within the services, and you agree to bear all damage, loss, or expenses caused to you or the company in this context.
40.4 It is clarified that the above does not detract from your responsibility for your device, including its security. Also, it is clarified that certain actions you take on your device, such as “jailbreaking” it, may damage the security of the information and services, and in addition, such actions may be illegal and prohibited.
41. You declare that you are legally competent to make the commitments specified in these terms of use, including your use of the site, unless otherwise stated in the agreement between you and one of the group companies. You are fully responsible for all uses you make of the website services.
Remedies
42. The group may, at any time and without prior notice, update any inaccurate or incorrect information you have provided, restrict your access to the site (including, but not limited to), and refuse to provide you with services in any of the following cases:
43. If there is a suspicion of a violation of the terms of use.
44. If it is impossible to verify and/or validate the information you provided.
45. If there is a reasonable suspicion and/or knowledge that your use of the services and/or products provided by the group companies presents a financial risk and/or fraud.
46. If the issuer of your card believes that your use of the services constitutes abuse of the payment method.
Refusal and/or Restriction of Site Use by the Group Companies
47. The group reserves the right to refuse and/or restrict access to the site, either permanently or for a limited time, at its sole discretion and without prior notice. If such access is suspended or restricted, a notification will be sent to you, except in exceptional cases where the suspension is due to the need to protect you and/or the group companies due to unusual use, including fraud and/or impersonation, in which case the services will be immediately terminated by the group.
48. Without detracting from the generality of the above, the group reserves the right to revoke, permanently or temporarily, your permission to use the site, including due to suspicion of misuse of services by you or a third party.
Jurisdiction
49. This document is governed by Israeli law and the laws of the State of Israel will apply.
50. The exclusive jurisdiction for resolving any disputes is the courts of Tel Aviv-Yafo.
